We operate this website and online store, including the information, content, features, products and services made available through it, to provide our customers with the Seoul by Ruby shopping experience.
Our online store is powered by Shopify.
These Terms of Service, together with any policies referred to in them, govern your access to and use of our website and your purchase of products from us.
By accessing our website, placing an order or otherwise using our services, you agree to these Terms of Service and our Privacy Policy.
Nothing in these Terms excludes, restricts or modifies any right or remedy available to you under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

You may use our website only for lawful purposes and in accordance with these Terms.
If you place an order with us, you represent that you have legal capacity to enter into the transaction or are otherwise authorised to do so.
You are responsible for ensuring that information you provide to us, including your name, email address, billing information and delivery details, is accurate and complete.
If you create an account, you are responsible for keeping your login details secure and for activity carried out through your account.
We may suspend or restrict access to our website where reasonably necessary to protect our business, our customers, our systems or other users.
2. Our Products
We take reasonable care to ensure that product descriptions, photographs, ingredients, sizes, quantities and other information displayed on our website are accurate.
However, product appearance may vary slightly from photographs due to lighting, photography, packaging production, screen settings or manufacturing variations.

Our products are cosmetic skincare products.

4. Orders
When you submit an order through our website, you are offering to purchase the selected products at the displayed price, subject to these Terms.
You will normally receive an automated confirmation acknowledging that we have received your order. This does not necessarily mean that your order has been accepted.
An order is accepted when we confirm that it has been accepted or when we dispatch the products, whichever occurs first.
We may decline or cancel an order where reasonably necessary, including where:
- a product is unavailable;

- we reasonably suspect fraud or unauthorised payment activity;
- incorrect pricing or product information has been displayed;
- delivery cannot reasonably be completed to the supplied address;

If we cancel an order after payment has been received and you are entitled to repayment, we will refund the relevant amount to your original payment method.
We reserve the right to limit quantities purchased by an individual, household, account or order where reasonably necessary, including to prevent unauthorised commercial resale.
5. Order Changes and Cancellations

Our fulfilment process may begin shortly after an order is submitted, so we cannot guarantee that an order can be changed or cancelled after it has been placed.
If you need to request a change or cancellation, contact us as soon as possible at support@seoulbyruby.com.
If your order has already entered fulfilment or been dispatched, it may need to be dealt with in accordance with our Returns & Refunds Policy.
Your statutory rights remain unaffected.
6. Prices and Payment
All prices are shown in the currency displayed on the website at the time of purchase.
Prices, promotions and discounts may change from time to time.
The price applicable to your order is the price displayed and accepted at checkout, subject to correction of genuine errors as permitted by law.
Shipping charges and any other applicable charges will be displayed before you complete your purchase where applicable.
You agree to provide accurate and authorised payment information.
By submitting payment details, you represent that you are authorised to use the selected payment method.
Payments may be processed by Shopify Payments or other third-party payment providers. Their own terms and privacy practices may also apply.
7. Pricing and Website Errors
We make reasonable efforts to ensure the information on our website is accurate, but occasional typographical, pricing, inventory or other errors may occur.
If we identify an obvious error affecting an order before dispatch, we may contact you to offer the opportunity to proceed on the corrected terms or cancel the affected order and provide an appropriate refund.
We will not use this provision to avoid an order merely because a promotion or price later becomes less favourable to us.

8. Discounts, Promotions and Promotional Codes
From time to time we may offer discount codes, promotional offers, gifts with purchase, bundles, rituals or other promotions.
Unless otherwise stated:
- promotional offers cannot be combined;
- discount codes have no cash value;
- a promotion may be subject to minimum purchase requirements;
- promotional gifts are subject to availability;
- promotions apply only during the stated promotional period; and
- promotions may be limited to one use per customer, household or order.
Specific promotional terms displayed with an offer will apply in addition to these Terms.
We may withdraw or correct a promotion where there has been an obvious error, fraud, misuse or technical malfunction, subject to applicable law.
9. Rituals, Sets and Bundles
Certain Seoul by Ruby products may be offered as a ritual, set, bundle or other combined offer.
A bundled price may differ from the total price of the individual products when purchased separately.
Returns relating to rituals, sets and bundles are governed by our Returns & Refunds Policy.
Where an individual product supplied within a ritual, set or bundle is faulty or otherwise fails to satisfy a consumer guarantee, your rights under the Australian Consumer Law are not affected by the fact that it was purchased as part of a set.
10. Shipping and Delivery
Shipping options, charges and estimated delivery times will be displayed where applicable during checkout or in our Shipping Policy.
Any delivery timeframe we provide is an estimate unless we expressly state otherwise.
Delivery may occasionally be affected by circumstances outside our reasonable control, including carrier delays, weather events, customs processes, industrial action or other disruptions.
We will take reasonable steps to assist with delivery issues where appropriate.
You are responsible for providing a complete and accurate delivery address.
Where an order is returned to us because an incorrect or incomplete address was supplied, or because delivery was refused or not collected, additional delivery charges may apply before the order is resent, except where the issue was caused by us or where applicable law provides otherwise.
Risk in physical products passes to you when the products are delivered to you or a person authorised by you to receive them, subject to applicable law.
11. Returns, Refunds and Consumer Guarantees

Our products come with guarantees that cannot be excluded under the Australian Consumer Law.
Depending on the circumstances, you may be entitled to a repair, replacement, refund or other remedy where goods fail to satisfy an applicable consumer guarantee.
Our discretionary policies relating to change-of-mind returns do not restrict your statutory rights.

All products are subject to availability.
Adding an item to your cart does not reserve that product.
We may introduce, modify or discontinue products from time to time.
If a product becomes unavailable after you place an order and we cannot fulfil that part of the order, we will contact you and provide an appropriate refund for the unavailable product.

Unless otherwise stated, all intellectual property associated with Seoul by Ruby and our website belongs to us or is used by us under licence.

- packaging and artwork;

- advertising creative; and
- original product and campaign content.
You may access our website for your own personal, non-commercial use.
You must not reproduce, copy, modify, republish, commercially exploit, distribute, scrape or use our intellectual property without our prior written permission, except where permitted by law.
No licence or ownership right is granted to you merely by accessing our website or purchasing our products.

You must only submit content that you have the right to provide.

16. Shopify
Our online store is powered by Shopify.
Shopify provides the ecommerce technology that enables us to operate our online store, but products purchased from Seoul by Ruby are sold by SEOUL BY RUBY PTY LTD, not Shopify.
Your purchase contract is therefore with us.
Shopify may process certain information relating to your use of our store as described in our Privacy Policy and Shopify’s applicable privacy documentation.
17. Privacy
Our collection, use, storage and disclosure of personal information is described in our Privacy Policy.
By using our website, you acknowledge that information may be processed by Shopify and other service providers that assist us with functions including payments, hosting, analytics, fulfilment, customer communications and website operation.

This section does not require you to indemnify us for loss caused by our own negligence, breach of law or wrongful conduct.

27. Governing Law
These Terms are governed by the laws applicable in Western Australia, Australia.
You and Seoul by Ruby submit to the jurisdiction of courts and tribunals with jurisdiction in Western Australia and any courts entitled to hear appeals from them.
Nothing in this clause prevents a consumer from exercising any right they may have under applicable consumer protection legislation in another jurisdiction.

We may update these Terms from time to time to reflect changes to our business, website, products, practices or legal obligations.

Changes will apply prospectively from their effective date and will not remove rights that have already accrued in relation to an existing purchase.
